Miscellaneous Instruments CASA 78/10 and CASA 109/10
Instruments CASA 78/10 (Instructions - for approved use of P-RNAV procedures) and CASA 109/10 (Instructions - RNP-AR approaches and departures) were registered on the Federal Register of Legislative Instruments on 17 March 2010 and came into effect on 18 March 2010. Instrument CASA 78/10 applies to the Cessna 680 aircraft VH-VPL operated by Twentieth Super Pace Nominees Pty Ltd, trading as SCT Logistics (the operator), and contains instructions which the operator must follow if using precision area navigation procedures. Instrument CASA 109/10 enables a controlled trial by Jetstar Airways Pty Limited of certain area navigation (required navigation performance authorisation required) instrument approach and departure procedures designed by Naverus Inc.

Miscellaneous Instrument CASA EX13/10
Instrument CASA EX13/10 (Exemption - agricultural rating (incendiary dropping at or above 500 feet)/Exemption - CASR Part 137 (incendiary dropping above or below 500 feet) was registered on the Federal Register of Legislative Instruments on 15 March 2010 and came into effect on 16 March 2010. This instrument exempts pilots and operators in incendiary dropping operations for controlled burning from the requirements of Part 137 of the Civil Aviation Safety Regulations 1998 and for operations at or above 500 feet from certain low level flying endorsements that might otherwise be required.

CASA ADCX 002/10
CASA ADCX 002/10 (Revocation of Airworthiness Directives) was registered on the Federal Register of Legislative Instruments on 9 March 2010 and came into effect on 10 March 2010. This instrument revokes Airworthiness Directives AD/DAUPHIN/93 and AD/HS-125/122 Amdt 1.
Miscellaneous Instrument CASA EX12/10
Instrument CASA EX12/10 (Exemption – CASR Part 99 DAMP requirements for foreign aircraft AOC holders) was registered on the Federal Register of Legislative Instruments on 5 March 2010 and comes into effect on 23 March 2010. This instrument exempts foreign aircraft Air Operator Certificate holders engaged in international air navigation in Australia, but not engaged in domestic air navigation in Australia, from the requirement in Part 99 of the Civil Aviation Safety Regulations 1998 to have a drug and alcohol management plan directed at employees and contractors engaged in safety-sensitive aviation activities, provided certain conditions are met.
Civil Aviation Order 82.6 Amendment Order (No. 1) 2010
On 5 March 2010, Civil Aviation Order 82.6 Amendment Order (No. 1) 2010 (the Amendment Order) was made by the Director of Aviation Safety. The Amendment Order amends Civil Aviation Order 82.6 to permit a trial of NVG for incendiary dropping and fire mapping in aerial fire fighting. The Amendment Order was registered on the Federal Register of Legislative Instruments on 5 March 2010 (FRLI number F2010L00628) and came into effect on 5 March 2010.

Civil Aviation Order 20.9 Amendment Order (No. 1) 2010
On 22 February 2010, Civil Aviation Order 20.9 Amendment Order (No. 1) 2010 (the Amendment Order) was made by the Director of Aviation Safety. The Amendment Order amends Civil Aviation Order 20.9 to allow operators of aircraft with less than 20 passengers to refuel aircraft with passengers on board provided they comply with certain conditions under the CAO and to allow operators to have the auxiliary power unit running during these refuelling operations provided it is in compliance with limitations in the Aircraft Flight Manual. The Amendment Order was registered on the Federal Register of Legislative Instruments on 2 March 2010 (FRLI number F2010L00542) and came into effect on 3 March 2010.

CASA ADCX 001/10 — Revocation of Airworthiness Directives (revokes AD/SA-TP/1, AD/SA-TP/2, AD/SA-TP/3, AD/SA-TP/4, AD/SA-TP/5, AD/SA-TP/6)
CASA ADCX 001/10 (Revocation of Airworthiness Directives) was registered on the Federal Register of Legislative Instruments on 26 February 2010 and came into effect on 27 February 2010. This instrument revokes Airworthiness Directives AD/SA-TP/1, AD/SA-TP/2, AD/SA-TP/3, AD/SA-TP/4, AD/SA-TP/5, AD/SA-TP/6.
Civil Aviation Order 100.16 Amendment Order (No. 1) 2010
On 18 February 2010, Civil Aviation Order 100.16 Amendment Order (No. 1) 2010 (the Amendment Order) was made by the Director of Aviation Safety. The Amendment Order amends Civil Aviation Order 100.16 to update the reference numbers and description of mandatory Brazilian documents used for the distribution of aircraft components. The Amendment Order was registered on the Federal Register of Legislative Instruments on 25 February 2010 (FRLI number F2010L00507) and came into effect on 26 February 2010.
CASA EX05/10 – Exemption – recency requirements for night flying (Skywest Airlines Pty Ltd) (expires end of 31 January 2012)
Instrument CASA EX05/10 (Exemption – recency requirements for night flying (Skywest Airlines Pty Ltd)) was registered on the Federal Register of Legislative Instruments on 25 February 2010 and came into effect on 26 February 2010. This instrument allows Skywest Airlines Pty Ltd to use an approved flight simulator to satisfy recency requirements instead of relying on flights in an aeroplane.
Miscellaneous Instrument CASA EX11/10 – Exemption – validation flight checks for AA (expires end of 24 February 2012)
Instrument CASA EX11/10 (Exemption – validation flight checks for AA) was registered on the Federal Register of Legislative Instruments on 25 February 2010 and came into effect on 25 February 2010. This instrument exempts Airservices Australia (AA) from the requirements of regulation 173.095 of the Civil Aviation Safety Regulations 1998, repeated in similar form in paragraph 6.1.2.4 of the Manual of Standards Part 173 (the MOS), that VFCs must be conducted by a pilot who is a CASA officer. It also exempts AA from the requirements of paragraph 6.1.2.5 and paragraph 7.1.5.3 of the MOS, that the aircraft to be provided by the designer (AA) must be approved by the CASA officer conducting the flight.

Instrument CASA 59/10 (Instructions – for approved use of P-RNAV procedures) was registered on the Federal Register of Legislative Instruments on 16 February 2010 and came into effect on 17 February 2010. This instrument applies to the Bombardier BD-700-1A10 aircraft VH-OCV operated by Execujet Australia Pty Limited (the operator) and contains instructions which the operator must follow if using precision area navigation procedures.

Miscellaneous Instrument CASA 56/10 – Authorisation – to issue maintenance release and carry out maintenance on experimental, amateur-built or kit-built aircraft (expires end of 31 January 2011)
Instrument CASA 56/10 (Authorisation - to issue maintenance release and carry out maintenance on experimental, amateur-built or kit-built aircraft) was signed by the Acting Executive Manager, Standards Development and Future Technology Division, on 1 February 2010. This instrument replaces CASA 71/08 which expired on 31 January 2010.
Miscellaneous Instruments CASA EX06/10, CASA EX07/10, CASA EX08/10 and CASA 34/10
The following instruments were registered on the Federal Register of Legislative Instruments on 1 February 2010 and came into effect on 1 February 2010: CASA EX06/10 (Exemption - solo flight training using ultralight aeroplanes registered with Recreational Aviation Australia Incorporated at Parafield Aerodrome); CASA EX07/10 (Exemption - solo flight training using ultralight aeroplanes registered with Recreational Aviation Australia Incorporated at Launceston Aerodrome; CASA EX08/10 (Exemption - solo flight training using ultralight aeroplanes registered with Recreational Aviation Australia Incorporated at Cambridge Aerodrome); and CASA 34/10 (Instructions – RNAV (RNP-AR) approaches and departures). Instrument CASA EX06/10 allows Forsyth Aviation to conduct solo flight training for its students using ultralight aeroplanes registered with Recreational Aviation Australia Incorporated. Instrument CASA EX07/10 allows Tasmanian Aero Club to conduct solo flight training for its students using ultralight aeroplanes registered with Recreational Aviation Australia Incorporated at Launceston Aerodrome. Instrument CASA EX08/10 allows The Aero Club of Southern Tasmania to conduct solo flight training for its students using ultralight aeroplanes registered with Recreational Aviation Australia Incorporated at Cambridge Aerodrome. Instrument CASA 34/10 enables a controlled, Australia-wide trial by Qantas Airways Limited of certain Area Navigation (Required Navigation Performance-Authorisation Required) instrument approach and departure procedures (RNAV (RNP-AR) IAP and IDP) designed by Naverus Inc.

Miscellaneous Instruments CASA EX03/10 and CASA EX10/10
Instruments CASA EX03/10 (Exemption - gross weight for operation of Aerochute 34m2 powered parachutes) and CASA EX10/10 (Exemption - display of markings and carriage of identification plates) were registered on the Federal Register of Legislative Instruments on 1 February 2010 and came into effect on 1 February 2010. Instrument CASA EX03/10 allows Aerochute Industries to operate its powered parachute aeroplanes as if they were covered by Civil Aviation Order 95.32. Instrument CASA EX10/10 grants a general exemption from compliance with subregulations 45.045(1), 45.145(1), subparagraph 45.065(3)(b)(ii) and item 1 of paragraph 45.065(3)(c) of the Civil Aviation Safety Regulations 1998 to all Australian fixed-wing aircraft and rotorcraft with a maximum take-off weight of less than 5700 kg operating wholly within Australian territory.
