Miscellaneous Legislative Instrument CASA EX51/08 – Exemption - recency requirement (expires end of July 2010)

On 25 September 2008, the Deputy Chief Executive Officer, Operations, signed an instrument (CASA EX51/08) that exempts ATC licence or flight licence holders from the recency requirement in subregulation 65.025 (1) of the Civil Aviation Safety Regulations 1998. The instrument was registered on the Federal Register of Legislative Instruments on 30 September 2008 and comes into effect on 1 October 2008.

Civil Aviation Order 100.66 Amendment Order (No. 2) 2008

On 22 September 2008, Civil Aviation Order 100.66 Amendment Order (No. 2) 2008 (the Amendment Order) was made by the Director of Aviation Safety. The Amendment Order: (a) amends Civil Aviation Order 100.66 (CAO 100.66) to make it clear that maintenance simulation technology and aeronautical products rather than a fully assembled and functioning aircraft could be used for the purpose of acquiring effective maintenance experience; (b) extends helicopter privileges enjoyed by certain MA holders because their existing training adequately covers the matters involved; (c) makes some minor corrections to CAO 100.66. The Amendment Order was registered on the Federal Register of Legislative Instruments on 30 September 2008 (FRLI number F2008L03543) and comes into effect on 1 October 2008.

Miscellaneous Legislative Instrument CASA 502/08 – Approval - conduct of emergency procedures proficiency tests

On 26 September 2008, the Group General Manager, General Aviation Operations, signed an instrument of approval for certain chief pilots to conduct the emergency procedures proficiency test on certain other chief pilots (CASA 502/08). The instrument facilitates chief pilots' access to appropriate testers.

Miscellaneous Legislative Instruments CASA EX40/08 and CASA EX65/08

The following instruments were registered on the Federal Register of Legislative Instruments on 22 September 2008: CASA EX40/08 and CASA EX65/08. Instrument CASA EX40/08 applies to the provision of a UNICOM service by Airservices Australia (AA) at Dubbo, Hervey Bay, Olympic Dam, Port Macquarie and Wagga Wagga Aerodromes. It exempts AA from compliance with subregulation 139.385 (2) and regulation 139.395 of the Civil Aviation Safety Regulations 1998 in respect of paragraph 14.4.1.3 of Part 139 of the Manual of Standards. It came into effect on 23 September 2008. Instrument CASA EX65/08 allows properly qualified and eligible Airservices Australia air traffic controllers at peak times of the year to perform air traffic control functions for up to 21 days without holding the relevant licence or rating for the function, pending its issue by CASA. It comes into effect on 1 October 2008.

CASA 496/08 – Direction - Cessna 441 Conquest (expires end of 18 September 2009)

On 18 September 2008, the Director of Aviation Safety signed an instrument of direction (CASA 496/08) that applies to each operator, and each pilot, of a Cessna 441 Conquest that has 22,500 hours or more time-in-service and is an Australian aircraft or a foreign registered aircraft in Australian territory. The direction is to the effect that the aircraft may not be flown at any time or for any purpose while the direction is in force unless, being satisfied that it is safe to do so, the Director approves in writing the details of the flight, including the time, route, purpose and risk mitigators. The instrument was registered on the Federal Register of Legislative Instruments on 19 September 2008 and came into effect on 19 September 2008.

CASA 477/08 – Permission – carriage of parachutists (expires end of 30 September 2010)

On 16 September 2008, the Group General Manager, General Aviation Operations, made an instrument (CASA 477/08) that grants permission to parachutists to be carried on the external parts of an aircraft while engaged in parachuting operations conducted by members of the Australian Skydiving Association.

Miscellaneous Legislative Instrument CASA 440/08 – Instructions - for approved use of P-RNAV procedures (expires end of 31 August 2010)

On 9 September 2008, the Acting Group General Manager, Air Transport Operations, made an instrument (CASA 440/08) that applies to specially equipped Airbus 380-800 aircraft operated by Qantas Airways Limited (Qantas) and contains instructions that Qantas must follow if using precision area navigation procedures. The instrument was registered on the Federal Register of Legislative Instruments on 18 September and comes into effect on 19 September 2008.
